Brother Michael Carthage Proctor

Brother Michael Carthage Proctor was born on 7 January 1932. He was a Christian Brother who taught at St Joseph’s College Nudgee in Brisbane, Qld in the junior and senior schools in the 1960s and 70s. Brother Proctor was a former principal, teacher, sports and dormitory master. As dormitory master, he was responsible for the care and supervision of 50 – 60 boys. It is known that Brother Proctor also taught at the following schools during his service with the Christian Brothers:

  • St Columban’s College - Albion, Brisbane;

  • Mount Carmel College - Charters Towers, Qld; and

  • Ignatius Park College - Townsville, Qld.

Information brought forward to Moody Law has depicted Brother Proctor as being a violent person who took pleasure in dishing out physical punishment. On 23 October 2019, the Queensland Government passed the Civil Liability and Other Legislation Amendment Act 2019 (Qld). The reforms are in response to the recommendations by the Royal Commission into Institutional Responses to Child Sexual Abuse (Royal Commission). The reforms came into effect on 2 March 2020. In short, the legislation allows a person in the State of Queensland to bring an action for damages if they have suffered serious physical abuse while they attended or were placed at an institution such as a school, church or children’s home: s 33A. The Act also amends s 11A of the Limitation of Actions Act 1974 (Qld) allowing a person to bring forth an action for serious physical abuse no matter how long the abuse occurred in the past. In other words, the action is not statute barred as there is no limitation period for sexual and serious physical abuse. While the Act does not define ‘serious physical abuse’, it will be left up to the courts to do so in accordance with the facts of the matter.
